Inland Empire Waterkeeper and Orange County Coastkeeper filed a complaint against Alpha Materials Inc.

Contentions

PLAINTIFFS' CONTENTIONS:
Defendant allegedly violated the Storm Water Permit and the Clean Water Act by discharging its pollutants into area storm drains, leading to the Santa Ana River and, ultimately, the Pacific Ocean. Plaintiffs contended that those discharges were regulated by the Act.

DEFENDANT'S CONTENTIONS:
Defendant denied the allegations and asserted various defenses.

Result

The parties entered into a consent decree. Alpha Materials agreed to comply with the applicable water quality standards as outlined in the parties' agreement.
