Intelligent SCM LLC sued Qannu PTY Ltd., Bridget Victoria Speed, and Andrew Speed, involving allegations of fraud.

Contentions

PLAINTIFF'S CONTENTIONS:
Plaintiff accused defendants of a fraudulent scheme to steal services from plaintiff. Plaintiff was an international freight forwarder that arranged for the shipment of goods. Defendant business was a foreign business owned and operated by the individual defendants, who were also husband and wife. Defendant business was a package forwarding service that allowed Australian consumers to shop from US-based online and brick and mortar retailers that do not ship directly to Australia. The parties allegedly entered into an oral agreement in 2012. Defendant allegedly did not pay plaintiff for services rendered. Plaintiff filed this instant action alleging fraud, breach of contract, quantum meruit, and money had and received.

DEFENDANTS' CONTENTIONS:
Defendants disputed plaintiff's allegations and issued a general denial. Defendants also asserted various affirmative defenses, including lack of jurisdiction.

Result

The parties ultimately reached a settlement. Accordingly, the court entered judgment in the amount of $157,500 against Victoria Speed and in favor of Intelligent SCM. The court also ordered Quannu to pay Intelligent SCM $182,649 pursuant to a default judgment entered against it on Sept. 30, 2016.
