Facts

Erika Arreola and minors Anjelica Arreola and Adriana Arreola, by and through their Guardian ad Litem, Erika Arreola, sued the Los Angeles Unified School District and the County of Los Angeles, in connection with a fatal hit and run that occurred on April 20, 2012.

Contentions

PLAINTIFFS' CONTENTIONS:
Minor plaintiffs and their father were crossing Santa Anita Blvd. at its intersection with Watts Ave. at a marked school crosswalk when a Cadillac Escalade failed to yield and struck them. Their father, Jose Arreola, died on the scene while minor Anjelica was rendered a quadriplegic. Plaintiffs alleged that the roadway created a dangerous condition. Plaintiffs sued alleging causes of action for negligence-wrongful death, negligence-dangerous condition of public property, negligence (failure to protect, supervise, provide safety to students and family) Government Code Section 815.2 and special relationship, and negligent infliction of emotional distress.

DEFENDANTS' CONTENTIONS:
The School District denied the allegations and asserted various affirmative defenses.

Result

The county settled the case for $2.6 million.
