Facts
On Nov. 7, 2014, plaintiff Carleen Jansson was struck by defendant Ronald Fernandez's vehicle while she was walking across Spencer Ave. and Pacific St. in Fountain Valley. Plaintiff had no recollection of the accident and she was faulted for causing the accident by the responding police officer. At the time of the accident, Fernandez was in the course and scope of employment with Restaurant Depot.
Contentions
PLAINTIFF'S CONTENTIONS:
Plaintiff alleged that Fernandez was negligent in the operation of his vehicle. Plaintiff alleged he could have, and should have, seen plaintiff crossing the street, and should have been able to avoid the accident.
DEFENDANT'S CONTENTIONS:
Defendants disputed liability and blamed plaintiff for causing the accident and alleged she was inattentive while crossing the street.
Injuries
Plaintiff sustained fractured ribs, a severe concussion and a brachial plexus traction nerve injury.
Result
The case settled for $1 million.
