Facts

Plaintiff was a developmentally disabled minor confined to a wheelchair. She suffered from spina bifida, seizure disorder, and other medical conditions. She was placed at the health care facility owned and operated by Darbun Enterprises Inc., dba All Saints Healthcare for health care and custodial care. While at All Saints, plaintiff suffered a displaced spiral fracture of her left femur.

Contentions

PLAINTIFF'S CONTENTIONS:
Plaintiff contended that the fracture occurred due to the negligence of defendant's staff in providing her long-term care. She claimed that defendant knew she had brittle bones and that she was extremely fragile. She sued Darbun Enterprises for medical negligence and willful misconduct.

DEFENDANT'S CONTENTIONS:
Defendant denied plaintiff's allegations and asserted various affirmative defenses.

Result

The parties settled for $50,000.
