Contentions
PLAINTIFFS' CONTENTIONS:
Plaintiffs were crossing the street when they were struck by a vehicle being driven by defendant Wilks near the intersection of Hollywood Way and Pacific Ave. in Burbank. Plaintiffs were injured and sued defendants for negligence and negligent infliction of emotional distress.
DEFENDANT'S CONTENTIONS:
Defendant denied the allegations and asserted various affirmative defenses.
Injuries
Wicks struck Mateo on her left leg, causing her to fall on top of her daughter Nguyen, who then hit her head on the pavement. Mateo was diagnosed with a head injury while Nguyen suffered from a contusion/abrasion in her forehead, sprain in her elbow and knee as well as post-traumatic stress disorder.
Result
The parties agreed to settle for $36,000. Of the total sum, Mateo was set to recover $24,000 and Nguyen $12,000.
