Facts

William Tufts Jr. was a securities registered representative associated with Crown Capital Securities. Tufts and Crown Capital petitioned the court to confirm an arbitration award rendered by the Financial Industry Regulatory Authority.

Contentions

PETITIONERS' CONTENTIONS:
Petitioners contended that respondent initiated the underlying FINRA arbitration seeking to recover damages he allegedly incurred in connection with investments he made through petitioners. Because the arbitration panel ruled in petitioners favor, they claimed they were entitled to confirmation of the arbitration award recommending expungement of all references to the underlying arbitration from Tufts' registration records.

Respondent did not oppose the motion.

The court granted the petition.
