PETITIONER'S CONTENTIONS:
In 1976, petitioner was convicted of murder and other charges. Originally sentenced to death, his sentence was later changed to life imprisonment. In 2014, the Board of Parole Hearings denied him parole. Petitioner subsequently filed for habeas relief, which the superior court denied. The state appellate and superior courts summarily denied his appeal. Petitioner then filed this instant petition for federal habeas relief. Among other things, petitioner contended that his parole hearing violated the ex post facto clause. Petitioner also challenged the Board's finding of future dangerousness, lack of insight, and other findings.
RESPONDENT'S CONTENTIONS:
The Attorney General moved to dismiss the petition on the ground that petitioner failed to present a cognizable claim for habeas relief.
Result
The court agreed with the Attorney General and the magistrate's recommendation that the case be dismissed. Accordingly, the court dismissed the case with prejudice.
