Facts

The plaintiff, 60, had a long-standing history of extropia (left eye drifting outward), with two strabismus surgeries as a child. Over the preceding two years, she noted a worsening of the condition. She went to an ophthalmologist who indicated that surgery was the only way to correct the problem (45-degree deviation), and that there may be a need for more than one surgery. The plaintiff underwent surgery and the initial result was good and almost perfect, but she immediately noted the onset of double vision post surgically. However, the plaintiff allegedly failed to follow the physician's instructions for post-operative rehabilitation and her condition deteriorated (to 20 degrees - still better than pre-op).
