Facts

Michael Polito, dba Tri Valley Construction Co., provided construction services to customers. United States Secretary of Labor Elaine Chao filed a lawsuit against Polito alleging wage and hour violations.

Contentions

PLAINTIFF'S CONTENTIONS:
The plaintiff claimed that Polito failed to accurately maintain records of employees' wages and hours worked. In addition, the plaintiff alleged that Polito did not compensate employees at the proper rate for overtime hours.

Result

The parties reached a settlement whereby the defendant paid $175,000 in back wages and liquidated damages, and $20,000 in civil penalties.
