Facts

On April 24, 2004, Jimmy Lowe was injured after his motorcycle allegedly hit a pothole causing him to go over the handlebars. He was driving eastbound on MacArthur Avenue in Oakland when the accident occurred. Lowe sued City of Oakland claiming that the city was negligent by failing to provide a safe roadway.

The city filed a cross-claim against Pacific Gas & Electric (PG&E) and Andes Construction Inc. (Andes) for indemnity. PG&E filed a cross-claim against Andes also seeking indemnity.

Result

Lowe settled with the city of Oakland for $60,000, PG&E for $25,000, and Andes for $5,000.
