Facts
On May 3, 2007, plaintiff Drew Dakota Bianchi, 21, was a passenger in a Toyota Avalon when a Peterbilt truck driven by defendant Samuel Bimbela struck the Toyota. The collision occurred after an initial collision between Bimbela, driving his Peterbilt truck, and co-defendant Michael Demma, driving a Gordon Trucking 18-wheel big rig, struck each other at or near the centerline on State Route 152 (Pacheco Pass). Thereafter, Bimbela's vehicle struck the car in which plaintiff was the passenger.
The plaintiff brought suit against both truck drivers/trucking companies, as well as against State of California.
Injuries
Plaintiff claimed traumatic brain injury and the need for lifetime care.
Result
The jury awarded plaintiff $49,123,376 ($3.4 million in past medical expenses; $27.6 million in future medical expenses; $4.5 million for future lost wages; and $13.5 million in general damages). The jury attributed 35 percent fault to Gordon Trucking and Michael Demma, 60 percent to Samuel Bimbela and 5 percent to State of California.
