On April 9, 2007, Fred Ehrlich lost control of his 2000 Harley-Davidson Softail motorcycle while driving on Olympic Boulevard in Los Angeles. He sued defendant Todd A. Mitchell, the owner of a 2007 Subaru Outback, claiming that Mitchell drove his vehicle negligently and caused the accident.
Contentions
PLAINTIFF'S CONTENTIONS:
Ehrlich claimed that Mitchell was driving his Outback in the opposite direction of Ehrlich when he entered Ehrlich's lane, which caused Ehrlich to lose control of his motorcycle.
DEFENDANT'S CONTENTIONS:
Mitchell claimed that he never made contact with Ehrlich or his motorcycle.
