Published: Nov. 14, 2009 | Result Date: Apr. 13, 2009 | Filing Date: Jan. 1, 1900 |Case number: 07CC11174 Verdict – Defense
Facts
Gerard La Rocca was a dance instructor at Maple Conservatory of Dance. He sued Rhonda Meier Hanson for defamation.
Contentions
PLAINTIFF'S CONTENTIONS:
La Rocca alleged that Hanson made false statements about him to Charles Maple, La Rocca's employer and the owner of Maple Conservatory. He alleged that she accused him of committing a crime and participating in a pornography ring. La Rocca claimed that, as a result of Hanson's statements to Maple, he was terminated and his reputation was damaged such that he was less able to make a living.
DEFENDANT'S CONTENTIONS:
According to defense counsel, Hanson proved at trial that La Rocca had for years produced and appeared in pornography for profit, and that a prior employer had terminated plaintiff when she learned of his concealed activities. That prior employer, like the Maple Conservatory, offered ballet classes to young children. Some of plaintiff's porn was filmed in a dance studio. Hanson denied making any false or defamatory statements about plaintiff. Maple did not terminate La Rocca because of Hanson's comments.
Damages
La Rocca sought general, special, and punitive damages.
Injuries
La Rocca claimed emotional distress.
Result
The jury found in favor of Hanson on all claims. The court had previously dismissed two claims on a motion for nonsuit, according to defense counsel.
