On the evening of Oct. 31, 2005, a Nissan Maxima operated by defendant Christopher Hong collided with 22-year-old plaintiff Nathaniel Helm, as Helm was riding his bicycle in the intersection of Octavia and Page Street in San Francisco. The plaintiff was thrown over the Maxima and landed on the pavement. The defendant filed a cross-complaint against the city and county of San Francisco for indemnity, which was later dismissed without prejudice.
Contentions
PLAINTIFF'S CONTENTION: The plaintiff claimed the defendant was negligent when crossing into the intersection.
DEFENDANT'S CONTENTIONS:
The defendant claimed the plaintiff had been riding his bike on the sidewalk instead of the bike lane before entering the intersection, thus contributing to the collision. Also, the plaintiff did not wear a helmet or reflective clothes, and his bike reflector was small and relatively hidden.
Injuries
The plaintiff claimed bilateral foot pain, fractures in both feet, lack of mobility, headaches, lower back pain, and abdominal pain.
Result
A verdict was returned for the defense.
