Facts

Kyocera Corp. had been involved in significant and long-running intellectual property disputes with Eastman Kodak Co. Kodak had an ongoing post-petition infringement of 15 patents owned by Kyocera. Kyocera then filed an adversary proceeding against Kodak in Kodak's bankruptcy proceeding as one of its debtors and debtors-in-possession.

Result

Kyocera agreed to pay the bankrupt company $5 million to resolve all outstanding litigation and claims between the two companies, including Kyocera's recent patent infringement allegations.
