Facts

Plaintiff Siranush Mehrabyan was driving on Balboa Boulevard when she collided with a vehicle operated by Kristopher Higgins in June 2010.

Contentions

PLAINTIFF'S CONTENTIONS:
Mehrabyan filed suit against Higgins, alleging motor vehicle negligence. She contended that she was driving in the right lane of the three-lane roadway when she was rear-ended by Higgins.

DEFENDANT'S CONTENTIONS:
Higgins contended he was traveling in the rightmost lane when Mehrabyan merged from the middle lane, stopping short, causing the accident.

Injuries

Mehrabyan claimed she sustained a lower back injury due to the collision, for which she received chiropractic treatment. In September 2010, Mehrabyan was diagnosed with a lumbar herniation, also treated by a chiropractor. Higgins contended Mehrabyan's injury was pre-existing resulting from two prior accidents.

Result

The jury rendered a verdict for the defense.
