Facts

The Cheyenne River Sioux Tribe filed suit against Dirk Kempthorne, Henry Paulson, and Ross O. Swimmer, seeking money damages and equitable relief. The plaintiffs claimed that the defendants breached their fiduciary duties to administer the plaintiffs' trust funds and trust assets with full care and responsibility. They failed to provide a full, accurate and timely accounting of the trust funds and mismanaged Tribal assets such as land leases, royalties and rights of way.

Result

The parties settled for $38,500,000.
