Michael Weiner hosted a radio show on Talk Radio Network since 2002. In 2010, Talk Radio tried to renew Weiner's contract in opposition to a syndication deal offered by Courtside radio.
Contentions
CLAIMANT'S CONTENTIONS:
Weiner entered into arbitration with Talk Radio, alleging its counteroffer included illegal, anti-competitive provisions and imposing additional terms not contained in the Courtside proposal. He further alleged that Talk Radio's proposal forced him to arbitrate, while continuing to syndicate his show during the process. Weiner claimed withholding of compensation during arbitration.
RESPONDENT'S CONTENTIONS:
Talk Radio filed suit, seeking to vacate the arbitration award. Talk Radio alleged fraud, undue influence and misconduct during the proceedings.
Result
The arbitration panel found that Weiner was entitled to terminate his contract due to Talk Radio's withholding of compensation, awarding him $862,455. The court confirmed the arbitration panel's decision.
