Facts

Jane Doe, a former Playboy bunny, claimed musician, Sammy Hagar, fathered her child after an affair in 1988. At that time, Hagar and Doe reached a settlement whereby Hagar made payments during her pregnancy in exchange for her silence regarding belief about the paternity. The child died shortly after birth and paternity was never established. In 2011, Hagar published a memoir stating he had intercourse with Doe, but did not believe he was her child's father. He also wrote he was unsure the baby was ever born.

Contentions

PLAINTIFF'S CONTENTIONS:
Doe filed suit against Hagar, alleging defamation, false light invasion of privacy, breach of agreement, and intentional infliction of emotional distress.

Result

The court rendered a summary judgment for the defense, finding Hagar did not refer to her by name in the book and there was no evidence of actual harm to Doe to support a defamation claim.

Doe has filed a notice of appeal to the 8th Circuit.
