Facts
The Football Association Premier League, representing a proposed class of copyright owners, sued Google Inc.'s YouTube Inc., alleging copyright infringement in relation to the broadcasting of copyrighted videos on YouTube. The class was made of up copyright owners whose proprietary content defendant allegedly copied, stored, electronically disseminated, publicly displayed and performed without authorization of plaintiff copyright owners.
Contentions
PLAINTIFF'S CONTENTIONS:
Plaintiffs alleged that YouTube used plaintiffs' copyrighted materials with active and knowing encouragement of copyright infringers in order to directly benefit financially via brazen acts of copyright infringement.
DEFENDANT'S CONTENTIONS:
Defendant argued that it could not be liable for having a general awareness regarding video that might be illegally posted.
Result
The judge denied class certification for the class.
