On Oct. 4, 2008, Ryan Colello drove a truck on Interstate 280 in San Jose, and his wife, Randi Colello, was sitting in the front passenger seat. A truck driven by Juan Armenta rear-ended Colello's car while his vehicle was stopped.

The Colellos sued Armenta and Bob Morris, who was Armenta's employer.

PLAINTIFF'S CONTENTIONS:
Plaintiffs alleged that Armenta drove the truck negligently and that Morris should be held responsible for the accident as well.

DEFENDANT'S CONTENTIONS:
Defendants challenged the extent of the injuries.

Settlement Discussions

Plaintiffs demanded $50,000 and the defense offered $13,000.

Damages

Ryan Collelo sought $140 and Randi Collelo sought $28,083.

Injuries

Plaintiff suffered arthroscopy, back injury, epidural injections, lower back pain, neck injury, rotator cuff injury, shoulder impingent, soft tissue injury, and tendonitis. They received chiropractic care or physical therapy.

Result

The jury awarded plaintiffs $21,173, granting Ryan $890 and Randi $20,283.
