Facts
On Oct. 4, 2008, Ryan Colello drove a truck on Interstate 280 in San Jose, and his wife, Randi Colello, was sitting in the front passenger seat. A truck driven by Juan Armenta rear-ended Colello's car while his vehicle was stopped.
The Colellos sued Armenta and Bob Morris, who was Armenta's employer.

Plaintiffs alleged that Armenta drove the truck negligently and that Morris should be held responsible for the accident as well.
