Facts
On April 11, 1995, defendant Shannon Bueltell was giving a try out for a driving position to Alan Hendrix in a tractor-trailer on an icy road on U.S. Highway 34 in rural Washington County. The plaintiff's insured was driving a tractor and pulling a loaded cattle on the same road, traveling in the opposite direction. The defendant lost control of Bueltell's truck and slid accross the highway, blocking the path of the plaintiff's insured and causing a three-truck collision. Plaintiff Lee Ohrman Trucking Inc. brought this action against defendant Shannon Bueltell and Alan Hendrix based on negligence. The defendant brought a counterclaim against the plaintiff for negligence. Hendrix failed to show for deposition. Ed Burns was the employee/driver for Lee Ohrman Trucking Inc.
