Facts
On Nov. 22, 1994, plaintiff Dona Penn, a 52-year-old business owner, was driving her automobile on Parker Road in Arapahoe County in icy conditions. A semi-tractor trailer, traveling in the opposite direction, slid on the ice across the double yellow lines, striking the plaintiff's vehicle and causing a truck-car collision. The truck was owned by defendant Dillon Companies and driven by its employee. The plaintiff settled with the non-parties before trial, and brought this action against the defendant based on negligence and respondeat superior theories of recovery.
