Facts

The McEvoy Group LLC sued John Harris for breach of written guaranty.

Contentions

PLAINTIFF'S CONTENTIONS:
Plaintiff contended that defendant Harris failed to pay it for an amount due in connection with the sale of McEvoy Media LLC even though he guaranteed payment under the purchase agreement.

DEFENDANT'S CONTENTIONS:
Harris contended that plaintiff failed to present evidence that it was not in breach of the guaranty and that its claim for damages was subject to a factual dispute. Harris claimed plaintiff was not entitled to summary judgment.

Result

The court granted plaintiff's motion for summary judgment, and directed that judgment be entered against Harris for $641,636, plus prejudgment interest.
