Plaintiff sued defendants after she slipped and fell on a patch of ice while walking on a sidewalk at her apartment complex in Victorville on February 3, 2011. Defendants were the property owner, property manager and landscape company servicing the property. Summerridge 121 LP and Investment Concepts Inc. settled with Perez. The trial proceeded against Liberty Landscaping Inc. only.
Contentions
PLAINTIFF'S CONTENTIONS:
Perez contended that an errant sprinkler caused water to pool and freeze over in the location of the sidewalk where she fell. She claimed that defendants failed to properly maintain the premises, causing a dangerous condition.
DEFENDANT'S CONTENTIONS:
Liberty Landscaping contended that Perez and the other defendants were at fault.
Settlement Discussions
Perez made a demand for $75,000 and the defense offered $25,000.
Injuries
Perez claimed injuries to her buttocks, shoulder and back, including a cervical disc herniation.
Result
The jury returned a defense verdict, finding that Liberty Landscaping was not negligent.
