Facts

Matthew Mitchell sued Oracle Racing Inc. d/b/a Oracle Team USA for an alleged breach of contract.

Contentions

PLAINTIFF'S CONTENTIONS:
Defendant allegedly used plaintiff as a scapegoat before the America's Cup jury. Plaintiff alleged that a crewmate added weight to the race boat using resin, violating the rules. Plaintiff claimed that had defendant fired said crewmate, he would have been treated favorably before the America's Cup jury. As such, plaintiff sued defendant for breach of contract, negligent retention of said crewmate, and punitive damages.

DEFENDANT'S CONTENTIONS:
Defendant moved to dismiss plaintiff's complaint for lack of standing. Defendant claimed that, for one, the jury knew about the alleged conduct. As such, it would not have caused plaintiff's injury. Defendant also claimed that plaintiff failed to allege facts sufficient to sustain a cause of action.

Result

The court granted the dismissal motion without prejudice.
