Gregoria Martinez sued Northridge Hospital Medical Center in connection with a slip and fall accident that allegedly occurred on July 22, 2011.
Contentions
PLAINTIFF'S CONTENTIONS:
Plaintiff was a patient at defendant's emergency department when she slipped and fell on a puddle of water that accumulated on the floor due to a defective water fountain. Plaintiff fell to her knees, causing a fracture. As such, plaintiff sued defendant for premises liability for creating a dangerous condition and failing to warn of the dangerous condition.
DEFENDANT'S CONTENTIONS:
Defendant denied plaintiff's allegations. Several witnesses allegedly claimed that there was no water on the floor as plaintiff claimed. Defendant accused plaintiff of malingering.
Damages
Martinez sought $900,000 in total damages.
Injuries
Martinez allegedly fractured her patella and underwent surgery to repair it. However, despite surgery, she continued to experience pain and a limited range of motion. Martinez also claimed she now suffered from a permanent limp as a result of her injuries.
Result
The jury rendered a verdict in favor of the hospital.
