PLAINTIFF'S CONTENTIONS:
Plaintiff alleged that defendants failed to properly compensate Telephone Sales Representatives for all hours that they worked in violation of both California law and the federal Fair Labor Standards Act. In particular, plaintiff asserted causes of action for failure to pay overtime in violation of the Labor Code, failure to provide meal periods, failure to provide rest periods, failure to furnish proper wage statements, violations of Business and Professions Code Section 17200, and failure to pay overtime compensation under FLSA.
DEFENDANT'S CONTENTIONS:
Defendant denied any wrongdoing.
Result
The parties reached a $3.6 million settlement.
