The General Counsel to the National Labor Relations Board filed a complaint against Vista Del Sol Health Services Inc. dba Vista Del Sol Healthcare for alleged unfair labor practices under the National Labor Relations Act.
Contentions
COMPLAINANT'S CONTENTIONS:
The NLRB contended that Vista Del Sol granted wage increases to employees in order to discourage them from supporting SEIU-ULTCW, Service Employees International Union, and United Long Term Care Workers. It also allegedly told employees that it no longer trusted them in response to their union activities.
RESPONDENT'S CONTENTIONS:
Vista Del Sol contended that the administrative law judge erred when she found that it violated the Act.
Result
The NLRB affirmed the judge's rulings in part and reversed them in part. It found that Vista Del Sol violated the National Labor Relations Act, and ordered Vista Del Sol to cease and desist from violating the law and to take certain affirmative action necessary to effectuate the policies of the Act.
