A non-profit environmental organization sued defendant, a manufacturer of preproduction plastics, pursuant to the federal Clean Water Act.

Contentions

PLAINTIFF'S CONTENTIONS:
Plaintiff contended that defendant unlawfully dumped pollutants into storm water that ultimately discharged into the San Francisco Bay.

Result

Pursuant to the settlement reached between the parties, Tyco will undertake certain compliance-related measures. It will also pay $28,000 to the Clean Water Fund, $60,000 to plaintiff to defray its litigation costs, plus $15,000 to plaintiff to monitor future compliance.
