Luz Munoz sued defendants after she tripped and fell on Oct. 17, 2013. She brought claims for negligence, breach of statutory duty, and premises liability.

Contentions

PLAINTIFF'S CONTENTIONS:
Munoz contended that she tripped and fell over a dangerous condition consisting of a deep gap ditch and raised cement curb, resulting in bodily injuries. She claimed that defendants were liable for failing to maintain the property or provide warnings.

DEFENDANT'S CONTENTIONS:
The City of Westminster denied Munoz's allegations and asserted various affirmative defenses.

Result

The city settled with Munoz for $6,000.
