The Republic of Kazakhstan filed a motion to compel compliance with a subpoena duces tecum for production of business records issued to non-party Facebook Inc. Specifically, it sought the names, email addresses, IP addresses and MAC addresses relating to the Respublika Facebook page and the Ketebaev Facebook page.
Contentions
PLAINTIFF'S CONTENTIONS:
Kazakhstan contended that its servers were hacked, leading to the disclosure of confidential government emails by dissidents. It claimed that those behind the Facebook pages posted confidential information online.
DEFENDANT'S CONTENTIONS:
Facebook opposed Kazakhstan's motion, contending that the subpoena was unauthorized, unnecessary and improper. Facebook sought a motion to quash the subpoena.
Result
The court denied Kazakhstan's motion and quashed the subpoena without prejudice.
