Joesiah Bell sued the City and County of San Francisco (erroneously sued as the San Francisco General Hospital) and Marika Russell M.D. for alleged medical malpractice.
Contentions
PLAINTIFF'S CONTENTIONS:
Plaintiff was allegedly admitted at defendant hospital on March 20, 2012, where defendant doctor performed the subject surgical procedure in plaintiff's throat. The doctors allegedly failed to anesthetize plaintiff properly, which caused plaintiff to bite down on a tube and the tube broke off. The tube then became stuck in plaintiff's throat. Plaintiff continued to suffer pain because of the injuries and sued defendants for medical malpractice.
DEFENDANTS' CONTENTIONS:
Defendants denied the allegations and asserted various affirmative defenses. Defendants also moved for summary judgment, maintaining that their conduct fell within the community standard of care.
Result
Summary judgment was entered in favor of the defense.
