In February 1994, plaintiff Eleanor Reed, a hot dog vendor, purchased a residence from defendants Leonard and Marcia Sklar. The plaintiff claimed that the defendants failed to disclose defects, primarily of roof leaks. For approximately three years, the plaintiff attempted to protect the roof by nailing tarps onto it, but rain penetrated the tarps. The plaintiff brought this action against the defendants based on fraud theories of recovery. The plaintiff settled with the real estate broker defendants for $43,000, before trial, without authority from Sklars.
