Contentions

PLAINTIFF'S CONTENTIONS:
Hill filed suit against Nox Anabel Inc., alleging copyright infringement. Hill contended that Nox produced six dress styles, copying a distinctive and copyrighted bead design owned by her. She further contended that Nox employees were describing dresses as "Sherri Hill designs."

DEFENDANT'S CONTENTIONS:
Nox denied any wrongdoing, and denied that it copied and infringed plaintiff's designs.

Damages

Plaintiff sought damages/disgorgement and penalties in excess of $2 million.

Result

The parties agreed to resolve the case for $60,000.00. Nox, without admitting liability, voluntarily agreed not to sell or market dresses that might look similar to plaintiff's.
