Kevin Hagerty was driving his pickup truck on southbound 101 in Novato on Aug. 23, 2005, when he was rear-ended by a Jeep driven by Ashley Saia.

Contentions

PLAINTIFF'S CONTENTIONS:
Hagerty filed suit against Saia, alleging motor vehicle negligence. He contended that Saia was inattentive and failed to notice he had stopped for traffic.

DEFENDANT'S CONTENTIONS:
Saia conceded she caused the accident, but disputed causation of Hagerty's knee injuries and claimed damages.

Damages

Hagerty sought $200,000 in damages for past medical costs and $132,000 for past lost earnings, as well as pain and suffering damages.

Injuries

Hagerty claimed injuries to his back and knees.
