Facts
On Dec. 7, 2012, plaintiff Larayne Lockwood, 40, was traveling in the number one lane going northbound 101, south of Pleasant Valley Road. Due to stopped traffic, plaintiff applied her breaks, and a collision occurred between plaintiff and defendant Julie Marie Webb.
Plaintiff sued defendant driver and her husband Michael Webb, the owner of the car.
Defendant's car was towed from the scene of the accident.
Contentions
PLAINTIFF'S CONTENTIONS:
Plaintiff contended she came to a full stop, but defendant driver was traveling at an unsafe speed, in her Ford Taurus, and was unable to stop causing her to rear-end plaintiff's 2010 Toyota Prius.
Settlement Discussions
Plaintiff demanded defendants' policy limits of $250,000.
Injuries
Plaintiff claimed 5-6 millimeter right paracentral C5-6 level requiring cervical incision surgery. She also injured a disc herniation at C5-6 resulting in neck pain and radiculopathy. After 12 weeks of physical therapy, her range of neck motion improved.
Result
The case settled for $250,000.
