Facts

Cristina Carrillo sued Arthur Jauregui and Tennie Del Rosario, in connection with a motor vehicle accident that allegedly occurred on Oct. 7, 2012.

Contentions

PLAINTIFF'S CONTENTIONS:
Plaintiff was allegedly driving on the far right lane at the Ronald Reagan Freeway going east when an out-of-control vehicle collided with her vehicle. The vehicle, which was being driven by defendant Jauregui, spun out, crossed the lanes, and struck plaintiff's vehicle. As a result, plaintiff's vehicle also spun out and collided with defendant's vehicle again. Plaintiff sustained serious injuries, and sued defendant driver and defendant Del Rosario who allegedly owned the vehicle defendant driver was driving. Plaintiff alleged causes of action for negligence and vicarious liability.

DEFENDANTS' CONTENTIONS:
Defendants disputed the extent of plaintiff's claimed injuries.

Settlement Discussions

Carrillo made a CCP 998 demand of $850,000. Defendants made a CCP 998 offer of $250,000.

Injuries

Carrillo claimed serious injuries to her neck and spine and eventually underwent a disk replacement in 2013. Carrillo continued to experience pain and issues with her neck and spine despite receiving epidural injections. Carrillo also claimed she would need future neck surgery

Result

The jury found in Carrillo's favor and awarded her $693,948 in total damages, consisting of $151,959 in past medical expenses, $91,989 in future medical expenses, $100,000 for future wage loss, $100,000 for past non-economic loss, and $250,000 in future non-economic loss.
