Facts
On July 19, 2013, Robert McAfee was fatally shot by a Deputy with the Los Angeles County Sheriff's Department. McAfee's spouse and two minor children sued defendants, asserting claims under 42 U.S.C. Section 1983 based on unreasonable use of deadly force and unconstitutional policy, practice or custom. They also brought a claim for wrongful death.
Contentions
PLAINTIFFS' CONTENTIONS:
Plaintiffs contended that the Deputy chased McAfee without justification and then unlawfully shot and killed him.
DEFENDANTS' CONTENTIONS:
Defendants contended that the use of force was reasonable under the circumstances.
Result
The county settled with plaintiffs for $150,000.
