Facts

On Nov. 6, 1995, plaintiff Leslie Hanson, a 51-year-old self-employed contractor and Christopher Khoury, a 39-year-old laborer, were traveling in their pickup truck. The defendant driver Harvey Jass, was allegedly distracted by his cell phone and ran a red light. The plaintiffs' pickup truck struck the defendant's vehicle on the passenger side. Both plaintiffs were wearing their seat belts, and no emergency medical attention was sought at the scene. The plaintiffs brought this action against the defendant based on negligence.

Settlement Discussions

Plaintiff Hanson made a settlement demand for $45,000. Plaintiff Khoury made a settlement demand for $30,000. The defendant made offers of $4,500 to Hanson and $5,000 to Khoury.

Injuries

Plaintiff Hanson claimed that he suffered severe low back injuries that prevented him from working in the construction field. Plaintiff Khoury claimed that he suffered a dislocation of his right shoulder and various soft tissue injuries. He also claimed the need for subsequent surgery on his shoulder.

EXPERT TESTIMONY: Defendant's rebuttal witness testified that Hanson no longer worked as a construction contractor because of his small operation and changes in the oil refinery business, and not because of any injuries from the accident.
