Facts

Tamara Kay Bohler, a Mission Viejo accountant was criminally charged with the July 4, 2003, stabbing of Jean-Marc Weber and his son while they both slept. Weber, a well-known French chef in Los Angeles, survived the late-night attack but his son was not so fortunate and died from excessive blood loss.

Although Orange County sheriff deputies arrived quickly at the Weber home, Bohler had ran barefoot from the scene wearing only a long, black negligee. She was found 38 hours later in San Juan Capistrano covered in blood.

According to criminal trial testimony, on July 3, 2003, after Weber and his son, Alex, 13, had gone to bed, Bohler took a knife and attacked Weber as he slept. He managed to disarm her and then fled to a neighbor's house and called police. Bohler returned to the kitchen where she took another knife and went to Alex's bedroom and stabbed him 13 times. He later collapsed at the top of the stairs.

Despite her insanity defense, Bohler was eventually found guilty on Nov. 2, 2006, for the assault, battery, murder and attempted murder and was subsequently sentenced to life in prison without the possibility of parole.

Contentions

PLAINTIFF’S CONTENTIONS:
The plaintiff contended that the defendant intentionally stabbed and attacked the plaintiff and his son with a knife resulting in Weber’s injuries, the tragic death of his son, and all damages relating thereto.

DEFENDANT’S CONTENTIONS:
The defendant does not object to plaintiff’s contentions.

The plaintiff suffered knife wounds and scarring to face, neck, arms and hands. The son sustained fatal injuries/wrongful death.
