Millicent Sen was terminated from her position as a property manager for Francis Property Management Inc. allegedly for poor performance. Sen claimed she was owed unpaid overtime and waiting time penalties and brought a wage and hours lawsuit against her former employer, alleging violation of the California Labor Code.

Sen claimed that when she was initially hired in 1995, she was told by her supervisor to forgo recording her overtime hours even though she allegedly worked overtime almost every day in the 15 years that she worked for the company. She presented a calendar at trial documenting her overtime hours from the past four years. Francis Property disputed her claims.

Damages

Sen sought recovery of between $33,000 and $53,000 in total lost wages and penalties.

Result

The jury rendered a defense verdict.
