A.J. a minor by and though her guardians ad litem, Roderick Jessamy and Trisa Jessamy, filed suit against the government, alleging medical malpractice based on the negligent performance of a tracheotomy that allegedly caused a burn.

Contentions

PLAINTIFF'S CONTENTIONS:
Plaintiff alleged that the government was liable under the Federal Tort Claims Act because A.J. received a tracheotomy surgery at Naval Medical Center San Diego, which resulted in a burn to her airway, respiratory distress syndrome, permanent lung damage, major reconstruction surgery, and vocal chord damages. Plaintiff claimed that Defendant's employees deviated from the standard of proper medical care, and performed negligently.

Damages

Plaintiff sought $250,000 in general damages.

Result

The parties settled for $600,000.
