Facts

On Dec. 30, 2010, Norma Burns was walking across Neilson Way. A vehicle driven by Ronald Evitts hit her while turning left onto Neilson Way. Burns filed a lawsuit against Evitts and his company, Ronald Evitts Architect LLC.

Contentions

PLAINTIFF'S CONTENTIONS:
Plaintiff alleged that Defendant negligently operated his vehicle and that the company should be held vicariously liable. Specifically, Burns alleged that she was walking within a crosswalk and that the pedestrian walk light was on such that Defendant should have yielded the right of way to her.

Injuries

Plaintiff suffered tibial plateau fracture.

Result

The parties settled for $750,000.
