Facts
Tracey Mathershed was stopped in traffic when her vehicle was rear-ended by a vehicle operated by Misty Frias-Douglas. Mathershed sued Frias-Douglas and Gary Douglas, the vehicle's owner. Mathershed contended that Frias-Douglas was highly intoxicated at the time of the accident. Mathershed asserted that prior to the subject accident, Frias-Douglas had approached other vehicles, crashed into one that was trying to turn out of the lane, and then continued driving in a quick, violent and intoxicated manner until plowing into the back of Mathershed's vehicle.
Frias-Douglas did not contest liability.
Damages
Mathershed sought $70,000 for past medical expenses and an unspecified amount for pain and suffering.
Injuries
Mathershed claimed severe injuries to her neck, back, and both knees. After an MRI, it was discovered that she had incurred a medial meniscus tear of the left knee. After a year of attempting to treat with physical therapy, she was instructed to undergo a meniscectomy.
Result
The parties settled for $137,500.
