Facts
On Oct. 31, 1999, the decedent was struck by a 1997 white Nissan pickup truck, driven by the defendant, as she
crossed Sixth St. at its intersection with Angeleno in the City of Burbank. The decedent was in the crosswalk at
the time. She died at the hospital on the day of the accident, a short time after massive head and body injuries.
The decedentÆs seven adult children filed this action against the defendant, the
defendantÆs father who was the owner of the vehicle that struck the defendant, and the City of
Burbank.
Other Information
The plaintiff entered into a good faith settlement with the defendant driver which the city opposed on the grounds that the defendant driver had failed to disclose her financial condition. The court did not grant the good faith motion on that basis but continued it so as to allow the city discovery on the defendantÆs financial condition. After discovery was complete, the good faith motion was granted and the driver settled with the plaintiffs. Thereafter the city moved for summary judgment and the motion was granted.
