Facts

Plaintiffs Steve and Lisa Purdum owned a home in San Diego, California. They filed suit against defendants All Trades Construction and Thomas Gabrielli regarding the construction of the home, claiming negligence, fraud, alter ego, breach of implied warranty, and breach of contract.

Contentions

PLAINTIFFS' CONTENTIONS:
The Purdums alleged that All Trades and Gabrielli were negligent and careless in the design, development, manufacture, building, contracting, conversion, maintenance, construction, installation, marketing and production of their home. They also contended that the defendants did not perform their duties in a workmanlike manner or in accordance with plans and governing codes.

Damages

The Purdums claimed that investigation of the problems, past repairs, relocation costs, and repair of deficiencies totaled $700,000 in damages.

Result

The jury found in favor of the Purdums and awarded damages, reduced by 2 percent comparative fault.
