On Aug. 15, 2006, defendants Daniel Alberts and Richard Rolfes performed a right fifth digit hammertoe and right ingrown halux surgery on plaintiff Carmen Anderson at St. Luke's Medical Center. Anderson sued Alberts and Rolfes for medical malpractice.

PLAINTIFF'S CONTENTIONS:
Anderson claimed that the defendants' negligent surgical evaluation, surgery, and follow-up procedures caused a post-operative infection, which resulted in the amputation of her toes. Anderson asserted that the defendants committed negligence because they did not inform her of the danger involved in the procedure.
Injuries
Anderson suffered toe amputations and an infection.
Result
The jury found in favor of the defense, concluding that Anderson provided informed consent and that Alberts did not act negligently.
