Facts
Briarwood Capital LLC filed suit against KBR Group LLC and others alleging mismanagement of a $500 million development of a master-planned community and country club in Rancho Santa Fe. The lawsuit also alleged that defendants engaged in self-dealing, diverted project funds, and failed to account properly for the project.
Damages
Plaintiff sought more than $300 million in compensatory damages, plus punitive damages and other relief.
Result
A bench trial on the equitable claims resulted in a victory for defendant Lennar, one of the leading home builders and land developers in the U.S. the court awarded Lennar approximately $18 million in damages and other compensation.
